Client Cooperation: To deliver our services (especially data analysis and coaching), you agree to provide timely access to necessary information, assets, and data. We are not liable for project delays caused by a lack of client cooperation.
2. Fees, Payments, and Refunds
Our Materials: We retain all intellectual property rights in our pre-existing materials, business coaching frameworks, strategic methodologies, and template designs used on this website or during our delivery of services.
Project Deliverables: Upon full and final payment of all outstanding invoices, ownership of the specific custom deliverables created for you (such as your finished website design, custom code, or brochure artwork) will transfer to you.
Client Materials: You warrant that any text, images, or data you provide to us to build your website or analyze your marketing does not infringe on any third party’s intellectual property rights.
3. Intellectual Property (IP)
Payment Terms: You agree to pay all fees in accordance with the payment schedule outlined on our invoices or service agreements.
Late Payments: We reserve the right to suspend work, pause ongoing coaching sessions, or temporarily restrict access to completed website designs if invoices remain unpaid past their due date.
Refund Policy: Our services are subject to the protections guarantees provided under the Australian Consumer Law. Outside of our statutory obligations under the ACL, fees paid for completed services, scheduled coaching sessions, or custom website design milestones are generally non-refundable.
4. Relying on Data, Coaching, and Advice
No Guarantees of Financial Outcome: Our business coaching, strategy approaches, and marketing analysis are designed to guide and support your business development. However, we do not guarantee specific financial returns, revenue increases, or commercial success resulting from our services.
SEO Dynamics: You acknowledge that Search Engine Optimization (SEO) algorithms are controlled entirely by third parties (like Google). While we use industry-standard practices, we cannot guarantee specific page rankings or traffic volumes.
5. Limitation of Liability
Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy implied by the Competition and Consumer Act 2010 (Cth) that cannot be lawfully excluded.
